What is personal data?

A data controller means the individual or organisation which, alone or jointly with others, determines the purpose and means of the processing of personal data.

All hard copy client records are stored securely under lock and key. All electronic data is kept securely on a password protected computer.

I receive contact form emails through the www.mindbodytech.co.uk website, which is hosted by WEEBLY INC, (USA). Contact form submission therefore involves email transfer of personal data outside the UK. You can visit the private policy of WEEBLY INC at this web address: https://www.weebly.com/uk/privacy. NES Health portal and cloud storage data is encrypted to military standards and stored by OVA, Canada.

The purposes of my website are to provide information about my services, professional accountability, contact details, as well as a contact form facility for enquiries about my services and related products. It also provides information links to other organisations and specialised products that may of interest to people who visit my website. I do not collect or receive data from these links. Neither do I recommend, endorse or enjoy any financial or other interests in connection with making such links available.

Your rights

Individuals can exercise their Individual Rights at any time. As mandated by law I will not charge a fee to process these requests, however if your request is considered to be repetitive, wholly unfounded and/or excessive, I am entitled to charge a reasonable administration fee.

For example if you make a request for me to delete all your personal data, I may be required to retain some data for legal purposes as advised by my insurance cover requirement.
You should understand that when exercising your rights, a substantial public or vital interest may take precedence over any request you make. In addition, where these interests apply, I am required by law to grant access to this data for law enforcement, legal and/or health related matters.
How long do I keep your personal information?
Client records will be kept for at least 7 years after your last session for adults and for at least 7 years after the 18th birthday of a minor, in line with my professional insurance policy requirements.
Legality
For the purposes of meeting the Data Protection Act 2018 territorial scope requirements, the United Kingdom is the named territory where the processing of personal data takes place.
Any dispute or claim arising out of this Privacy Policy and the use of your personal information will be governed by English law and the courts of England and Wales have exclusive jurisdiction to resolve any such dispute or claim.
